1. Agreement to Terms
By accessing or using UpScout's website monitoring service, you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access the service. These Terms of Service apply to all users and others who access or use our service.
2. Service Description
UpScout provides website uptime monitoring services that include:
- Regular monitoring of specified websites and endpoints
- Automated notifications for downtime and performance issues
- Performance analytics and reporting
- API access (for eligible plans)
- Integration with third-party services
3. User Accounts
Account Requirements
You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account.
Account Restrictions
You may not share your account credentials or transfer your account to others. We reserve the right to suspend or terminate accounts that violate these terms or engage in unauthorized activities.
4. Service Usage
Acceptable Use
You agree to use the service only for lawful purposes and in accordance with these Terms. You may not:
- Use the service to monitor websites you don't own or have permission to monitor
- Attempt to gain unauthorized access to our systems or other users' accounts
- Interfere with or disrupt the service or servers
- Circumvent any rate limiting or access restrictions
5. Payment Terms
Subscription fees are billed in advance on a monthly or annual basis. Free trial periods may be offered for certain plans. You authorize us to charge your provided payment method for all applicable fees.
If your payment method fails or your account becomes delinquent, we reserve the right to suspend or terminate your access to the service. All fees are non-refundable except where required by law.
6. Service Level Agreement
We strive to maintain high service availability but cannot guarantee 100% uptime. Our service level commitments include:
- Target uptime of 99.9% for our monitoring infrastructure
- Prompt notification delivery for detected incidents
- Regular system maintenance with advance notice
- Technical support response within specified timeframes based on your plan
7. Limitation of Liability
UpScout provides the service "as is" without any warranty. We shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the service. Our total liability for any claims shall not exceed the amounts paid by you for the service in the twelve months preceding the claim.
8. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of significant changes via email or through the service. Continued use of the service after such modifications constitutes your acceptance of the updated terms.
